Terms of Service
These Terms govern your use of Sizee — a size and fit recommendation app for Shopify-powered apparel stores ("the Service"), operated by Bluethread Brands Private Limited ("we", "us", "Sizee").
1. Acceptance
By installing the Sizee app on your Shopify store, or by using the Sizee widget as a shopper, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
2. The Service
Sizee provides:
- A merchant-facing admin app embedded in Shopify, for configuring product metadata, size guides, and widget appearance.
- A shopper-facing storefront widget that recommends a garment size based on the shopper's measurements, body shape, and brand history.
- A backend recommendation engine that scores fit and produces a size recommendation with confidence level.
3. Subscription & billing
- Sizee plans are billed monthly or yearly in US dollars via the Shopify Billing API.
- All paid plans include a 1-month free trial. You can cancel before the trial ends and you will not be charged.
- After the trial, your selected plan auto-renews until you cancel. You can cancel any time from the Pricing page inside the app.
- Refunds are handled per Shopify's billing policy. We don't pro-rate mid-month cancellations.
- Plan limits (active products, recommendations per month, brand references) are enforced. If you exceed them, you'll be prompted to upgrade.
4. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the recommendation engine.
- Use Sizee to violate any law, infringe intellectual property, or harm any person.
- Resell the Service or sub-licence it.
- Use Sizee to collect data on shoppers for any purpose other than serving them a size recommendation.
- Submit fabricated garment measurements designed to manipulate recommendations.
5. Your content
You retain ownership of your product catalog, garment measurements, widget customisation settings, and any data your shoppers provide via the widget on your store. We process this content only to operate the Service. On uninstall, your data is deleted within 30 days. You may export your data at any time by writing to us.
6. Our content
The Sizee software, recommendation engine, brand size charts, calibration data, marketing site, logos, and documentation are owned by Bluethread Brands and licensed to you for use only while your subscription is active.
7. Recommendation quality
Sizee provides recommendations based on garment measurements you upload, brand size charts we maintain, and shopper-provided body data. Recommendations are estimates: actual fit depends on fabric, stretch, individual preference, and other factors outside our control. We do not guarantee that any recommendation will result in a perfect-fitting purchase.
8. Service availability
- We aim for 99.5% uptime on the recommendation API. Maintenance windows are announced in advance.
- Scale plan customers receive priority support and additional SLA terms in their contract.
- We are not liable for downstream losses (lost sales, lost conversions) resulting from Service downtime, except as required by applicable law.
9. Limitation of liability
To the maximum extent permitted by law, Sizee's total liability for any claim arising out of or related to the Service is limited to the amount you have paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages.
10. Termination
- You may uninstall the Sizee app at any time from your Shopify admin.
- We may suspend or terminate access if you breach these Terms, are abusive to our support team, or attempt to compromise the Service.
- On termination, your subscription ends at the close of the current billing period. Data is deleted per the Privacy Policy.
11. Changes to the Service
We may add, change, or remove features over time. Material changes that reduce functionality you've paid for will be announced at least 30 days in advance and you can cancel without penalty if affected.
12. Governing law
These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts of New Delhi, India, except where applicable consumer protection law gives you a non-waivable right to bring action in your local jurisdiction.
